Information Sharing

The Company does not and will not sell or disclose your personally identifiable information to marketers outside of the Company, and will only share personally identifiable information as provided below and within the Company.

The Company may engage third party service providers to perform various services on our behalf.  We may need to share your personally identifiable information with them.  We require that our service providers keep personally identifiable information confidential and not disclose it to third parties, and not use it for any other purpose.  For example, we may rely on a service provider to fulfill your product and service requests and answer your questions, host our web sites, mail products samples, manage payments, analyze data to send more targeted communications to you, conduct research and analyze data to improve our products, services, and web sites.

In other situations, we may disclose your personally identifiable information if the Company is sold to another company or the Company acquires or merges with another company, where permitted by law to protect and defend the rights and property of the Company, including the Terms of Use, and when required by law or any governmental authority.

Cookies and Other Technologies

The Company may make use of “cookies” on the Site.  Cookies are small text files that are stored on a user’s computer by a web server based on the permissions set in a user’s browser software.  A cookie itself is not designed or intended to read any information from a user’s computer (other than the contents of the cookie); rather, it is an identifier used by the web site that originally placed it on your hard drive.  The actual contents of the cookie information can be retrieved by the same server to identify the computer and subsequently to customize, monitor, or regulate the use of a site based on information stored in the cookie and the host server.  Therefore, cookies only identify the user’s computer to the web site that may correlate other information, including personally identifiable information, with the cookie. Cookies allow the Company to automate access and data entry functions of the Site such as login information, correlate online ordering information for purchases, tailor the Site to your preferences or interests, or customize promotions or marketing, including advertisements on other web sites. In addition, cookies allow us to track usage of the Site to determine which areas are useful or popular and which are not, thereby enabling us to improve and update the Site effectively.  You have the ability to accept or decline the use of cookies. Most browsers automatically accept cookies, but you may modify your browser setting to decline cookies if you prefer. If you choose to decline, you may not be able to fully experience the interactive features of the Site.

We may allow third parties, including business partners and ad networks, to display advertising on the Site.  Some of these companies may place a cookie on your computer to recognize your computer each time they send you an online advertisement.  This enables them to understand where you, or others who are using your computer, saw their advertisement and deliver ads that they believe are of interest to you.  We do not control these companies’ use of cookies.

Security

The Company uses reasonable efforts to protect your personally identifiable information collected through the Site from access, loss, misuse, alteration, or destruction by any unauthorized party.  We limit access to personally identifiable information to those who have a business need.  We keep personally identifiable information only for a reasonably needed amount of time.  When we provide your personally identifiable information to our third party service providers, we require those companies to protect the information and not use the information for any other purpose.  When we collect or transmit sensitive information, such as a credit card number, we use industry standard methods to protect that information.

Information Transfer

Your personally identifiable information may be transferred to, stored, and processed in a country other than the one in which it was provided.  This may include the United States.  When we do so, we transfer the information in compliance with applicable data protection laws.  We take steps to protect personally identifiable information no matter what country it is stored in or transferred to.  We have procedures and controls as appropriate to help sure this.

California Do Not Track Disclosures

At this time, we do not respond to do-not-track signals from browsers or other consumer choice mechanisms regarding the collection of behavioral tracking data. While we collect personal information from you as described above, we do not collect personal information from you to monitor your online activities across third party websites or online services and over time (also known as behavioral advertising or interest-based advertising). We do not use or allow third parties to collect personal information from you on the Site in order to monitor your online activities across third party websites or online services and over time.

Children’s Online Privacy

We care about the privacy of children and recognize that children’s use of the internet and email raise special concerns regarding privacy and security of information.

It is our intention to adhere to the Children’s Online Privacy Protection Act and its rules on collecting personally identifiable information from minors.  We remind and encourage all parents to check and monitor their children’s online activities.

We do not intend to collect personally identifiable information from children under the age of 13 online, and if we determine that a child under 13 has provided personally identifiable information, the Company will delete that information.

Parents have the right to review and have deleted any personally identifiable information we have collected from their children, and refuse to permit further collection of that information.  If you believe that we might have any information from or about a child under 13, please contact us at legal@drfresh.com.

We are also committed to protecting the online privacy rights of minors under the age of 18. If you are a California resident under the age of 18, you may request the removal of any user content or information posted by you on the Site by contacting us at legal@drfresh.com. In your request, please specify clearly what information you have posted that you would like us to remove. We will comply with your request as soon as practicable. Please note, however, that our removal of any content or information posted by you from the Site does not ensure the complete or comprehensive removal of the content or information from the internet, and in certain situations we may not be able to remove the content, such as when we are required by law to maintain the content.
